Fair earnest money on a short sale?

I recently put an offer in on a short sale. After months of waiting the bank came back but wanted the house to close within 10 days when we stated we would need 30-45 days in the initial contract. I made an adjustment to the contract for a later date and sent it back. After this adjustment I ran into a problem with money and told my real estate agent that I wanted to stop moving forward. I did this before any response to the adjusted contract. Without my knowledge, my real estate agent cashed my check. Do I have a case to get this money back?
